1. Introduction
These terms and conditions ("Agreement") outline the rights and responsibilities between Laser Tag In A Box ("we," "us," "our") and the customer ("you," "Hirer"). By proceeding with the booking, you acknowledge that you have read and agreed to these terms.


2. Pandemic Outbreaks - COVID-19 / Coronavirus
In case of a pandemic outbreak like COVID-19 or other, we will follow national and local guidelines for operations. If we need to cancel your hire booking due to COVID-19 or other, we'll reschedule it for a future time that suits you. Please note, refunds won't be provided for existing bookings. Your credit will be valid for 24 months. As a small business, we aren't liable for additional costs resulting from these changes.


3. Customer Cancellation Due to COVID-19 / Coronavirus
Transfer of dates due to covid will only be accepted if their is a national, regional or local lockdown that is published on gov.uk.  Refunds won't be granted for cancelled bookings. We're not liable for associated costs resulting from cancellations.


4. Refunds Due to COVID-19 / Coronavirus
Given the pandemic's impact on businesses, we're unable to process refunds. However, if there is a national, regional or local lockdown at the time of your booking, bookings can be rescheduled within the next 2 years, or we can issue credit notes / vouchers.  No refunds will be made.


5. Identity of Parties
Laser Tag In A Box refers to us (Laser Tag In A Box, Laser Tag Hire), and the Hirer refers to you, the company making the booking, or the person making the booking on your behalf. This encompasses all associated parties, employees, and agents.

In addition to the terms mentioned earlier, the parties agree to the following:


7. Safety/Operating Instructions
In addition to the information set forth in this agreement, the Hirer acknowledges that there are safety and operating instructions for the equipment and agrees to read the instructions and operate the equipment, or allow the equipment to be operated or used in accordance with those instructions. The Hirer further acknowledges and understands that the Owner has not agreed to nor have they provided any other operators with this hired equipment, and that the Hirer is solely responsible for the correct and safe operation of the equipment. The Hirer understands that the participant’s safety depends on the Hirer providing at all times correct operation of and use of the equipment.
By entering into this agreement the Hirer acknowledges that there is a risk of injury or damage arising out of the use of the equipment. The Hirer agrees to keep and maintain safety rules for the safe operation of the equipment and to assume any and all risk of injury or damage. In particular, the Hirer will not permit the equipment to be operated by anyone who has not received instruction from the Hirer on the safe operation and use of the equipment, nor shall the Hirer allow any person to use or operate the equipment when it is in need of repair or when it is in an unsafe condition or situation.


8. Booking Procedure
Bookings are made through our online booking system on our website.  Once you have selected the date you wish to hire and the package and products you require, you can then read our terms and conditions and then checkout. We deliver the equipment to you 1-2 working days before the hire and we collect the equipment the next day after the hire ends.  Standard delivery and collection is included in the hire price. Standard delivery and collection is by DPD between 8am and 6pm and the delivery/collection must be signed for.  You can upgrade your delivery to a pre 12pm premium delivery for an additional cost.
Once you have completed your booking and payment has been made, you will receive a confirmation email from us with all the details of your booking.  Please check you’re booking confirmation to ensure email addresses and delivery/collection addresses and mobile telephone numbers are all correct.  If there are any mistakes please notify us immediately so we can make the necessary changes as we cannot be held responsible if the information provided is incorrect.  Please note we can not make changes to deliveries and collection addresses within 7 days of delivery or collection without our written permission.


9. Equipment Rental, Payment, and Term
The Hirer (customer) hires (rents) from the Owners certain equipment described on the confirmation of booking sent via email on receipt payment via the online booking system. The hire fee set forth is payable, in full, in advance and the hire term shall be listed on the confirmation of booking, but all the Hirer's obligations arising under the terms and conditions of this Hire Agreement shall run from the actual delivery of the equipment to the actual return/collection of the equipment. The Hirer shall not be entitled to any refund whatsoever if the Hirer elects not to use the Equipment due to weather or any other causes during the hire period.  Payment in due in full at the time of booking. We cannot ship your equipment without payment in full. Payment can be made through our online booking system by Paypal or by stripe using all major credit and debit cards such as Visa debit, Visa, MasterCard or your PayPal account. For on the day bookings, payment must be processed and approved before release of the equipment.  By proceeding with the booking you agree that Laser Tag In A Box reserves the right to modify, update, or amend any terms and conditions of this Agreement subsequent to the commencement of your hire period. Such changes may include, but are not limited to, adjustments in pricing, delivery charges, policies, or procedures.


10. Weather Conditions
We reserve the right to cancel or reschedule the Hirer's rental prior to delivery if severe weather conditions are imminent or if the Owners have any reason to believe that the Equipment and/or it's users may be in danger.   An example of this is severe snow storms and severe gales.  The Hirer agrees that in the event that the weather turns to severe during use of the Equipment then the Hirer will cease using the Equipment until this severe weather ends. The Hirer will also take all precautions to secure the Equipment in an undercover, safe weatherproof area during severe or inclement weather.  The Hirer agrees not to use the equipment in weather conditions such as lightening, thunder and severe gales.


11. Equipment Delivery
Laser Tag In A Box Ltd shall deliver the Equipment to the registered cardholders billing address specified by the Hirer as listed at the time of ordering and on the confirmation of booking.  If you want the equipment delivered to an alternative address, this must be entered at the time of ordering and must be an address you are associated with, have used before and must have a named person to take delivery or hand over the collected equipment and sign for it. Please see clause 20.  Standard delivery/collection is between 8am and 6pm and the delivery/collection must be signed for.  You can upgrade your delivery to a pre12pm premium delivery for an additional cost.  We cannot upgrade collections at this time.
Please note; we accept no responsibility for late delivery or non collection if there is not anyone at the address  available to receive the equipment or give back the equipment.
DPD uses driver tracking software with GPS on and also take photographs and footage of addresses for non delivery and non collection.
11a. The hirer agrees that they are able to take delivery of the equipment on the delivery date within 1-2 days of their booking during the hours of 8am and 6pm, Monday- Friday not including Bank holidays.

11b. The hirer agrees that the equipment will be ready to be collected by the courier in its original packing on the collection date which is the day after the hire period ends.
11c. The hirer agrees to pay any redelivery and recollection charges should the courier have to be rebooked for either delivery or collection or any failed attempts to deliver or collect.
11d. The hirer agrees to not amend the courier delivery or collection via the notification text/email without prior written permission from us. The hirer may incur extra delivery/collection charges at our discretion. Deliveries typically occur between 8am and 6pm Monday – Friday, not including bank holidays.
11e. The hirer agrees to not amend the courier delivery or collection via the notification text/email without prior written permission from us.  This includes making requests for delivery and collection to safe places, back gardens, sheds, alternative addressed and unmanned locations.
11f. The hirer agrees to have all the equipment packed up and sealed with the tape provided, by the night before collection. The hirer must check all items are present.  Feel free to take photos of the boxes once ready.


12. Receipt/Inspection of Hire Equipment:
You will need to Inspect the equipment upon receipt, and notify us immediately of any issues.  The Equipment is available on an ‘as is' basis. The Hirer acknowledges that they have personally checked off and inspected the Equipment prior to it's use and will read the operating/safety instructions prior to use. The Hirer specifically agrees that the Equipment will not be used if the Hirer finds that it is not suitable for their needs.  The Hirer acknowledges receipt of all items listed on the confirmation of booking /packing slip/dispatch note, and that they are in good working order.  If any equipment is missing or not in good working order upon delivery please notify us immediately on 01865 410071 or 0799 9579583.


13. Possession/Title:
The Hirer's right to possession of the Equipment begins upon the Equipment being delivered to the Hirer's registered address (or upon pick up by the Hirer) and terminates on the actual pick up by the Owners (or agent) or return delivery by the Hirer to the Owners depot. Retention of possession, or any failure to permit the pick up of the Equipment at or after the end of the Hire Agreement Period specified on the confirmation of booking constitutes a material breach of this Agreement. In the event that the Equipment is not returned for any reason, including theft, the Hirer is obligated to pay Laser Tag In A Box Ltd the full replacement value for the Equipment listed on the confirmation of booking/packing slip/dispatch note, plus any and all incidental costs associated with the attempted pick up or recovery of the Equipment by the Owners.Title to and for all the Hire Equipment listed in the agreement is and shall remain the property of Laser Tag In A Box Ltd.  The Hirer agrees to keep the Equipment in his/her custody and control from the time the Equipment is delivered to the Hirer (or picked up by the Hirer) and until the Owners pick up the Equipment via courier at the specified date as detailed on your confirmation of booking (or delivered back to the Owners depot by the Hirer).
The Hirer shall not cause nor permit any of the Equipment hired to them to be sublet, rented, hired, sold, or removed from the Delivery Address, or otherwise transfer such items. If the hired items are not returned and/or levied upon for any reason whatsoever, Laser Tag In A Box Ltd may retake possession of said items without further notice or legal process and use whatever force is reasonably necessary to do so. The Hirer hereby agrees to indemnify, defend, and hold Laser Tag In A Box Ltd harmless from any and all claims and costs arising from such retaking and/or levy. If the Equipment is levied upon, or otherwise moved from the Delivery Address, the Hirer shall notify the Owners immediately.


14. Care of Hire Equipment:
The Hirer shall be responsible for any and all damage to any of the Hire Equipment not caused by ordinary wear and tear. Ordinary wear and tear shall mean only the normal deterioration of the Equipment caused by ordinary, reasonable and proper use of the Equipment. The Hirer shall be liable to the Owners of the Equipment for any and all damage that is not ordinary wear and tear in an amount equal to the replacement value of the hire equipment listed here. Damage which is not ordinary wear and tear includes but not limited to breakage, improper use, abuse, lack of cleaning, contamination or dirtying the Equipment with non-approved items such as solvents, chemicals, food, paint, mud, clay or other materials.


15. Current Replacement Prices:
These prices are excluding VAT, Import duties, Import VAT and delivery. Cobra Phaser £899.00, Red Dot Scope £55.00, Front phaser Sensor £15, Head Sensor £100.00, Headband £4.99, Electronics Replacement (do not submerge in water) £550.00, Medic Box £600, Phasor case £150, Trigger £8.50, Button £4, Aerial £35, Key £5, Flags £5, Domination box £600.


16. Equipment Problems:
Should any Equipment develop a problem, or should the equipment not function correctly at any time, the Hirer agrees to immediately cease use of the Equipment in question and to call us on 01865 410071 or one of our support staff on 07946 436660 (anytime)
If a problem develops and the Hirer does not understand the operating instructions, they will cease use of all equipment, and will not allow anyone else to continue use the Equipment until the problem is solved. If the Hirer cannot correct the problem, please call us 01865 410071 or one of our support staff on 07946 436660 (anytime)


17. Specific Safety Rules:
The following rules and warnings must be obeyed in the use of the Equipment at all times.
17a. All safety and operating rules must be complied with at all times.
17b. For the safety of any children participating in the use of the Equipment, ADULT supervision is required at all times.
17c. Upon setting up an area to allow participants use of the Equipment, check the area for tripping hazards and slippery conditions. Remove all waste and or builders rubble and ensure the area is free of any potential item that can cause injury or any risk of injury to the participants.
17d. Do not use the Equipment in or near any body of water. The Equipment CANNOT be submerged in water.
17e. Body contact can cause serious injury and should be avoided at all times.  The supervisor should ensure that participants refrain from running through doorways or around corners to avoid risk of collisions between the participants. Laser Tag is a high-intensity activity, the supervisor should ensure that participants takes breaks and avoid dehydration.


18. Limited Warranty:
Laser Tag In A Box Ltd warrants the Equipment hired under this Agreement will be in good working order when delivered under this Agreement. All the Equipment is supplied and maintained solely under this warranty. The Owner’s sole and exclusive obligation under this warranty is limited to repair or replacement of the Equipment, when the Owner determines that it does not conform to this warranty. The Owners make no warranty of merchantability or fitness for any particular use or purpose, either expressed or implied. There is no warranty or representation that the Equipment is fit for the Hirer's particular intended use, or that it is free from latent defects. The Owners shall not be responsible to the Hirer or to any third party for any loss, damage or injury resulting from, or in any way attributable to the operation, installation of, use of, or any failure of the hired Equipment. The Owners shall not be responsible for any defect or any failure unknown to them at the time of delivery.


19. Liability Release and Assumption of Risk:
Please note that there are inherent risks involved in outdoor or adventurous activities such as those which present themselves whilst playing with Laser Tag In A Box equipment. The hirer personally and voluntarily assumes the risks of any harm, trauma, injury or damage that may occur to any person or property whether foreseen or unforeseen in connection with the activity. As the hirer of the equipment the undersigned is/are responsible for the conscientious use of the equipment and shall be responsible for any loss or damage to the equipment. Laser Tag In A Box cannot and will not be held liable for any public liability when not directly supervising the event.  Laser Tag in a Box recommends watching the How to guide for safety tips and supervising the sessions at all times. By accepting these terms and conditions you acknowledge that you personally and voluntarily assume the risks of any harm, trauma, injury or damage that I may suffer to my person, and others participating, or my property whether foreseen or unforeseen in connection with the activities. As you are hiring the equipment you are responsible for the conscientious use of the equipment. You are responsible for any loss or damage of the equipment.


20. Troubleshooting
The Standard software settings are designed for Birthday Parties, group events, holiday camps, Youth Group Activities etc. The standard settings blocks access to team and games settings, changing these setting can result in phasers not tagging each other. Laser Tag in a Box recommends using the standard software settings. For those who choose the complex settings we recommend that you fully read the user guide and contact us on 01865 410071. Laser Tag in box takes no responsibility for equipment failing due to user error caused by miss use of the advanced settings


21. Requesting your equipment hire to be delivered to or/and collected from a work, home or business address that is different to your Billing address.
We understand our customers sometimes need to have their orders delivered and collected from a different address from their billing address (the address your card is registered to)
For security reasons, we can only deliver and collect from either the billing address or shipping adddress provided when ordering.
We also only permit the delivery and collection address to be different from the Billing address if there is a designated person responsible for the hire at the shipping address and the following conditions apply.
21a. The delivery and collection address is manned between the hours of 8am and 6pm and has someone available to be able to sign for delivery or hand back equipment during those times.
21b. You confirm that the responsible person at the shipping address will keep the equipment safe and stored securely during the hire period until it is handed over to you or collected by the driver.  You confirm and agree they are responsible for any losses of equipment.
21c. You are associated somehow with the alternative address eg, workplace, family, member etc.
21d. The address is not a holiday home, Airbnb, hotel, or accommodation you have checked out from.
We reserve the right to ask for further ID documents based on the value of the equipment being hired. Please note we do not send equipment out to unmanned receptions.


22. Provision of Services
We will supply the services to you from the date set out in the order for the period set out in the order.  We will make every effort to provide the services on time. However, there may be delays due to an Event Outside Our Control, see Clause 22 – Circumstances Beyond Our control.


23. Circumstances beyond our control
23.1. If there is failure to perform, or delay in performance of any of our obligations under these Terms due to Circumstances Beyond Our Control, we will not be liable for such failure.
23.2. Circumstances Beyond Our Control include but are not limited to, any Force Majeure, outbreak, act or event beyond our reasonable control, including without limitation lock-outs, strikes, or other industrial action by third parties, riots, civil commotion, terrorist attack or threat of terrorist attack, invasion, war (whether declared or not) or threat or preparation for war, explosion, fire, flood, storm, thunder and lightning storms, extreme heat, subsidence, epidemic, Pandemic, earthquake, or other natural disaster, or failure of private or public telecommunications networks.  This also includes any lockdowns regionally, locally and nationally or any restrictions imposed by the government, district councils or local guidance and any incidents locally.  This also includes requirements to self isolate. This also includes any variant of/and Covid.  This also includes issues with third parties such as couriers and delivery companies.  This also includes traffic incidents and motorway closures which may affect deliveries and collections.
23.3. Circumstances Beyond Our Control also includes low numbers, extreme weather, cold and hot, thunder and lightning, snow or other natural damages to our depot, vandalism of our depot, in these circumstances, we reserve the right to cancel your booking and offer an alternative date.  Please note in these circumstances, we do not offer any refunds in any circumstances.  We will transfer the session to another time or give you a credit note to re-book at another time.


24. Cancellation
When we have to cancel - Under circumstances out of our control as in accordance with Clause 22 above, including but not limited to; force majeure, Outbreaks of a pandemic, epidemics, low numbers, extreme weather, cold and hot, thunder and lightning, snow or other natural damages and also courier issues, we reserve the right to cancel your booking and offer an alternative date.  No refunds will be made.
When you want to cancel your booking - Cancellations forfeit all monies paid.
24a.1. The hirer agrees to secure their booking and date with the full payment.  This reserves the hire equipment from the system and prevents others from booking it.  All bookings are non-refundable but we are very happy to transfer the booking to another date if 30 days prior notice to the scheduled hire is given.
24a.2. You may transfer any order for our hire services prior to 30 days before your scheduled hire date detailed on your email confirmation of your booking, by emailing us at info@lasertaghire.co.uk with new dates. New dates are subject to availability.  We will confirm your request to transfer to another date in writing to you;  Please contact us if you have not received this within 48hrs of your transfer request email.
24a.3.  Decrease in numbers once booked -  We do not offer the flexibility to decrease numbers once your hire is booked, for example, if you book for 20 and then only need 15, no refunds or transfers will be made.  Please note we also do not transfer any unused equipment to alternative dates or credit them.


25. Compliance with Laws:
The Hirer agrees not to use or allow anyone else to use the hired Equipment in any illegal manner or in an unsafe manner. The Hirer agrees at his/her/their sole cost and expense to comply with all municipal, parish, council, state, federal or other government or quasi government laws, ordinances, and/or regulations which may apply to the use of the hired Equipment during the Hire period. The Hirer further agrees to pay all licences, fines, fees, permits, or taxes arising from the Hirer's use of the Equipment, including any subsequently determined to be due. The Hirer is solely responsible for obtaining all permits and/or licences from the appropriate government agencies to use.


26. Legal Fees:
In the event that an attorney is retained to enforce any provision of the Agreement, the prevailing party (the Owners) shall be entitled to recover the attorney’s fees and court costs in such action or proceeding, in an amount to be determined by the court or arbitrator.


27. Customer (Hirer) Acknowledgement:
The Hirer acknowledges and certifies that they have had a sufficient opportunity to read this entire Agreement online before booking, and agree to be bound by all the terms and conditions on all pages and that they understand it's content and that they execute it freely, intelligently and without duress of any kind.


28. Severability:
If any of the terms or conditions of this Agreement are found to be unenforceable, illegal or unconscionable by a court or competent jurisdiction, such item shall be stricken from this Agreement, and the remaining Terms and Conditions of this Agreement shall stay in force and effect.


29. Entire Agreement:
This Agreement constitutes the full agreement between Laser Tag In A Box Ltd and the Customer (Hirer). Any prior agreements, whether written or oral, promises, negotiations or representations not expressly set forth herein shall be of no force or effect.
By proceeding with the booking, you expressly acknowledge and agree that you have read, comprehended, and accepted all the terms and conditions as set forth in this Agreement. This acceptance constitutes a legally binding commitment governed by the laws of the United Kingdom.  You also agree that Laser Tag In A Box Ltd reserves the right to modify, update, or amend any terms and conditions of this Agreement subsequent to the commencement of your hire period. Such changes may include, but are not limited to, adjustments in pricing, policies, or procedures.

I HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT, INCLUDING THE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THEM. I FURTHER WARRANT AND REPRESENT THAT I AM THE CUSTOMER (HIRER) AN AM AUTHORISED AND EMPOWERED TO ACCEPT DELIVERY OF THE EQUIPMENT AND TO SIGN THIS AGREEMENT AND BY GOING AHEAD WITH THE BOOKING I FULLY AGREE TO THESE TERMS AND CONDITIONS LISTED ABOVE.
